These Terms of Service ("Terms") govern your access to and use of KairosPicks, operated by KairosPicks LLC ("KairosPicks," "we," "us," or "our"), including our website at kairospicks.com and all associated services, features, and content (collectively, the "Service").
By accessing or using the Service in any manner — including visiting the website, creating an account, or subscribing to a paid plan — you represent that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.
If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
KairosPicks is a sports data analytics and information platform provided for informational and entertainment purposes only. KairosPicks does not accept wagers, operate as a sportsbook, or facilitate gambling of any kind. KairosPicks is not a licensed gambling operator under Colorado law or any other applicable jurisdiction.
The Service aggregates publicly available sports odds data from third-party sources, provides AI-generated analysis of sports matchups and betting markets, and offers personal betting analytics tools including a wager log, capital manager, and staking calculators.
Nothing on KairosPicks constitutes betting advice, financial advice, or a recommendation to place any wager. All picks, analyses, predictions, and recommendations displayed on KairosPicks are informational in nature. Sports betting involves substantial financial risk. The fact that KairosPicks displays odds or analysis related to a sporting event does not constitute a suggestion, endorsement, or recommendation that you bet on that event.
Always verify current odds directly with your licensed sportsbook before placing any bet. Odds displayed on KairosPicks may differ from live sportsbook odds at the time you place a bet.
Past performance of any analysis, pick, or prediction displayed on KairosPicks does not guarantee or predict future results.
You must be at least 21 years of age to use KairosPicks. By accessing or using the Service, you represent and warrant that you are 21 years of age or older.
If we learn that a user is under 21 years of age, we will immediately terminate that user's account and delete any associated data. We do not knowingly collect information from individuals under 21.
If you are a parent or guardian and believe your child under 21 has created an account, please contact us immediately at legal@kairospicks.com.
KairosPicks is designed for use by residents of the United States in jurisdictions where accessing sports betting information and analytics is lawful. The Service is intended for users aged 21 or older located in US states where sports betting is legal or where accessing sports analytics information is not prohibited.
It is your sole responsibility to understand the laws of your jurisdiction and to comply with them. KairosPicks does not provide legal advice regarding the legality of sports betting or sports analytics services in your jurisdiction. If accessing the Service is prohibited by the laws of your jurisdiction, you may not use the Service.
Users outside the United States access the Service at their own risk and are responsible for compliance with all applicable local laws.

You may not create more than one account or create an account on behalf of another person without their authorization. We reserve the right to refuse registration or cancel accounts at our discretion.
Your account is personal and non-transferable. You may not sell, transfer, or assign your account or any account rights to another person.
KairosPicks offers the following subscription tiers:
Payment processing is provided by Stripe, Inc. By subscribing, you agree to Stripe's Terms of Service. KairosPicks does not store your payment card details; all payment information is held and processed by Stripe.
If your payment fails, we may suspend access to paid features until payment is successfully processed. We will notify you by email of failed payments.
Price changes: We will provide at least 30 days' advance notice by email before any change to your subscription price. Price changes take effect at the start of your next billing cycle after the notice period. Continued use of the Service after a price change constitutes your acceptance of the new pricing.
Free trials: If KairosPicks offers a free trial, a valid payment method is required to initiate the trial. Unless you cancel before the trial end date, your payment method will be charged automatically at the applicable subscription rate when the trial ends.
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until the end of the period for which you have paid.
Refund policy: Except as required by applicable law, all subscription fees are non-refundable. There are no refunds or credits for partially used billing periods. Canceling your subscription stops future charges but does not entitle you to a refund for the current billing period.
If you believe you were charged in error, contact us at billing@kairospicks.com within 30 days of the charge before initiating any chargeback with your payment provider. We will investigate and respond within 5 business days. Initiating a chargeback without first contacting us may result in account suspension.
Nothing in this section limits your statutory rights under applicable consumer protection laws, including any refund rights that cannot be waived by contract.
Pick analyses, recommendations, summaries, and other content generated by KairosPicks's AI features are produced by an artificial intelligence system powered by Claude, developed by Anthropic, PBC. By using AI-powered features, you acknowledge and agree that:
When you request AI analysis, your query and relevant context data (such as game and odds information) are transmitted to Anthropic for processing. This transmission is described in our Privacy Policy. Anthropic does not use submitted content to train its models, per its API usage policies.
Live odds data displayed on KairosPicks is sourced from The Odds API and other third-party data providers. KairosPicks does not guarantee the accuracy, completeness, real-time precision, or availability of any odds data. Specifically:

All team names, league names, sportsbook names, and related trademarks referenced on KairosPicks are the property of their respective owners and are used solely for factual, descriptive, and informational purposes.
All content on KairosPicks — including but not limited to the platform software, design, layout, graphics, text, AI-generated analyses, odds aggregations, tools, calculators, and the KairosPicks name and logo — is owned by or licensed to KairosPicks LLC and is protected by US and international copyright, trademark, and other intellectual property laws.
Subject to these Terms, KairosPicks grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes only. You may not:
User-submitted content: By submitting content to KairosPicks (including wager log entries, notes, and feedback), you grant KairosPicks a non-exclusive, worldwide, royalty-free license to store, process, and display that content solely as necessary to provide the Service to you. We do not claim ownership of your personal wager data.
You agree not to use the Service in any manner that:
We reserve the right to investigate suspected violations and may cooperate with law enforcement in prosecuting violations. We may terminate accounts that violate these prohibitions without notice or refund.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in full. In such jurisdictions, our liability is limited to the greatest extent permitted by law.
Important: KairosPicks is not liable for any gambling losses, betting losses, or financial losses of any kind that you may incur in connection with bets or wagers placed after using KairosPicks content, tools, or analyses. You bear sole responsibility for any gambling decisions you make.
You agree to defend, indemnify, and hold harmless KairosPicks LLC and its officers, directors, employees, agents, and licensors from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
KairosPicks reserves the right to assume exclusive control of the defense of any matter subject to indemnification by you, at your expense. You agree to cooperate with our defense of such claims.
Informal Resolution First: Before initiating any formal legal proceeding, you agree to contact KairosPicks at legal@kairospicks.com with a written description of your dispute and the relief you seek. We will attempt to resolve the dispute informally within 30 days of receiving your notice. If the dispute is not resolved within 30 days, either party may proceed to arbitration as described below.
Binding Arbitration: Except for disputes that qualify for small claims court, any dispute, claim, or controversy arising out of or relating to these Terms or the Service that cannot be resolved informally will be resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures for claims not exceeding $250,000, or the Comprehensive Arbitration Rules and Procedures for larger claims. Arbitration will be conducted by a single neutral arbitrator. The arbitration will take place in Denver, Colorado, or remotely at your option.
Federal Arbitration Act: This arbitration agreement is governed by the Federal Arbitration Act and evidences a transaction in interstate commerce. Colorado law governs the substance of any dispute.
Opt-Out Right: You may opt out of this arbitration agreement by sending written notice to legal@kairospicks.com within 30 days of first creating your KairosPicks account. Your opt-out notice must include your name, account email address, and a clear statement that you are opting out of arbitration. Opting out does not affect your ability to use the Service.
Small Claims: Nothing in this section prevents either party from bringing an eligible dispute in small claims court in Denver, Colorado, so long as the matter remains in small claims court and proceeds on an individual basis only.
Statute of Limitations: Any claim or cause of action arising out of or related to the Service or these Terms must be filed within one (1) year after such claim or cause of action arose, or be forever barred. This one-year limitation applies regardless of any statute or law to the contrary.
If a court finds this class action waiver to be unenforceable for any reason, then the entire arbitration agreement in Section 16 shall be null and void, and the dispute shall proceed in court.
These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions.
Subject to the arbitration agreement in Section 16, you consent to the exclusive jurisdiction of the state and federal courts located in Denver County, Colorado for any dispute not subject to arbitration. You waive any objection to venue in such courts.
We reserve the right to modify these Terms at any time. When we make material changes, we will:
Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service and cancel your subscription before the effective date.
We may suspend or terminate your account and access to the Service at any time, with or without notice, for any reason, including but not limited to violation of these Terms, suspected fraud, or non-payment of subscription fees.
You may terminate your account at any time by canceling your subscription through your account settings and discontinuing use of the Service.
Upon termination: (a) your license to use the Service immediately ends; (b) we may delete your account data consistent with our Privacy Policy and data retention practices; (c) all provisions of these Terms that by their nature should survive termination will survive, including Sections 10–18.
If we terminate your account for reasons other than a Terms violation, we will provide a pro-rated refund of any unused prepaid subscription fees.
KairosPicks is committed to promoting responsible gambling. We strongly encourage all users to gamble responsibly and within their means. Sports betting can be addictive and carries a risk of financial harm.
